1. Introduction & Scope

Welcome to Housing Finder. These Terms of Service ("Terms") govern your access to and use of the Housing Finder website, mobile web applications, and services operated by Housing Finder Platform Pty Ltd (referred to as "Housing Finder", "we", "us", or "our").

By accessing or using our platform, registering an account, or submitting enquiries, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately cease using the platform.

2. Description of Services

Housing Finder operates an online platform that bridges real estate activities. Services include:

• Hosting property advertisements for sale, rent, or lease by verified real estate agencies.
• A searchable directory of registered real estate agents and agencies across Australia.
• A platform linking property seekers with licensed mortgage brokers for credit advice and rate comparisons.
• AI-driven tools for generating property descriptions and agent bios under centralized corporate subscriptions.

3. User Accounts & Registration

To access specific features, including listing properties or receiving credit consultation, you must register for an account. We offer accounts for: Seekers, Real Estate Agencies, Real Estate Agents, Mortgage Brokers, and Mortgage Broker Agents.

You represent that all details provided during registration are accurate, complete, and current. You are responsible for keeping your login credentials confidential.

4. Property Listings & Content

Real estate agencies represent that they hold valid licensing and authorization under state laws (e.g., Property and Stock Agents Act 2002 in NSW) to list properties.

All content uploaded must be truthful, non-misleading, and free from intellectual property violations. Housing Finder reserves the right to remove any listing or content that violates guidelines or brings reputational harm to the platform.

5. Mortgage Broker Services & National Credit Act Compliance

Mortgage brokers on Housing Finder must hold an Australian Credit Licence (ACL) or be registered as an Credit Representative under the National Consumer Credit Protection Act 2009 (Cth).

Housing Finder does not provide direct credit advice or issue home loans. Any financial options, rates, or loan estimates are for indicative purposes only, and credit advice is delivered solely by your selected licensed mortgage broker.

6. Fees, Plans & Payments

Access to agency listing features, premium broker profiles, and advanced AI copywriter tools is subject to subscription fees under monthly, 6-monthly, or yearly plans.

Fees are charged in Australian Dollars (AUD) and processed securely via Stripe. Subscriptions renew automatically unless cancelled via the platform portal prior to the billing cycle expiration. Payments are non-refundable except as mandated under Australian Consumer Law.

7. Intellectual Property

The platform structure, software, logo designs, custom CSS layouts (design-system.css), design-system.js, and visual assets are the exclusive property of Housing Finder Pty Ltd. You are granted a limited, non-transferable licence to access the platform.

8. Liability & Disclaimers

Housing Finder lists properties and facilitates connections but is not a party to any transaction between property seekers, agencies, or mortgage brokers.

To the maximum extent permitted under law, we disclaim liability for any direct, indirect, or consequential loss arising from listing accuracy, broker advice, platform interruptions, or transactions conducted between parties.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia. Any disputes arising in connection with the platform shall be submitted to the exclusive jurisdiction of the courts of New South Wales.
